TERMS OF USE & PRIVACY POLICY

 

www.simpas.com.tr (hereinafter referred to as the “Site”) requires users accessing our website to carefully read these Terms of Use & Privacy Policy (hereinafter referred to as the “Policy”) before using the Site. If any of the terms specified in this Policy are not suitable, users should refrain from using the Site.

SİMPAŞ TURİZM A.Ş. (hereinafter referred to as “SİMPAŞ,” “our Company,” or “we”), which owns the Site, reserves the right to unilaterally change the general and specific conditions specified below at any time. It is important to revisit this page when visiting the Site to see any changes to the terms of use and privacy policy.

In this Policy, users who use the Site without registering are referred to as “Visitors,” while users who use the Site by registering are referred to as “Members.”

Terms of Use and Security Rules

In the following cases, the management of SİMPAŞ may block the use of the Site by Visitors and Members and reserves the right to take legal action against the person or persons involved in the following activities:

 

 

1.a. If false, irregular, incomplete, misleading information or expressions that are not in accordance with general moral values and the laws of the Republic of Turkey are recorded on the Site,

1.b. If the content and materials on the Site are copied in whole or in part for different purposes or are attempted to be used,

1.c. Members are responsible for sharing their username, password, or similar information with third parties or organizations, or if their password is used maliciously by others. Similarly, Members cannot use another person's IP address, email address, username, or other information, nor can they access or use the private information of other users without permission. Members are responsible for any administrative, legal, or criminal liabilities arising from such use.

1.d. If software is used or activities are carried out that threaten the general security of the Site, interfere with the operation of the Site and the software used, or attempt to access, delete, or modify information,

1.e. If the Member harms SİMPAŞ and/or the Site by exploiting a vulnerability (technical, etc.) in the campaigns, membership, sales, product delivery system, or any aspect of the Site, gains unjust benefits, engages in repeated actions, performs actions that do not meet the required conditions but still takes advantage of them, or if the misuse of campaigns, gift/product delivery/supply system, or the Site is detected by SİMPAŞ, the Company reserves the right to cancel the relevant transactions, terminate the Member's membership, and immediately terminate the loyalty program contract, if established, in addition to all rights granted by law.

1.f. SİMPAŞ is not responsible for any direct or indirect damages arising from the entry to the Site, the use of information and other data on the Site, or due to the violation of the Agreement or tort, except for cases of clear fault on the part of SİMPAŞ. SİMPAŞ is not liable for any interruptions in the process, errors, omissions, interruptions, deletions, losses, delays in transactions or communication, computer viruses, communication errors, theft, destruction, or unauthorized access, modification, or use of records.

1.g. SİMPAŞ reserves the right to change any services, products, contracts, and information provided on the Site unilaterally without prior notice, reorganize the Site, or discontinue its publication. Changes will take effect at the time of publication on the Site. Use of or access to the Site implies acceptance of these changes. These conditions also apply to other websites linked to from the Site.

1.h. The Site may contain links or references to other websites not under the control of SİMPAŞ. SİMPAŞ is not responsible for the content of these sites or the links they contain.

Content Usage

2.a. All rights are reserved for all texts, graphics, photos, videos, animations, sounds, software codes in the content of the Site. Unless otherwise stated, they cannot be used for commercial or personal purposes without permission and without citing the source. It is prohibited to publish any element from this Site in another medium or website or to link to it without SİMPAŞ's permission.

2.b. It is strictly prohibited to copy or use the software used in the design of the Site's pages and in the creation of the database, which are the property of our Company.

2.c. SİMPAŞ and the Site are open to all kinds of feedback and criticism. All such feedback submitted to the Site becomes the property of SİMPAŞ and may be used anonymously for marketing purposes.

Responsibilities

3.a. Visitor and Member information (visit duration, time, viewed pages, and any activities not limited to these) is tracked to provide better service. The obtained information may be shared with companies with which we collaborate for advertising and similar purposes, limited to enriching and improving our content while adhering to privacy principles. Our goal is to ensure that the Site meets your desired features and facilitates its development.

3.b. Visitors and Members agree to comply with the Turkish Penal Code, the Turkish Commercial Code, the Law on Intellectual and Artistic Works, the Law on Industrial Property, other related regulations, the Turkish Code of Obligations, and any announcements and notices published by SİMPAŞ regarding its services. Visitors and Members bear all legal, criminal, and financial responsibility for any misuse arising from failure to comply with these notices and laws.

3.c. Due to non-compliance with the obligations stated in this Policy or the general rules announced on the Site, SİMPAŞ may temporarily or permanently block a Member’s access to the Site and/or cancel the Member’s membership.

3.d. Visitors or Members cannot engage in activities that prevent or complicate the use of the Site by other visitors and members, cannot overload or lock servers or databases, and cannot attempt fraud. Otherwise, their membership or usage rights will be terminated, and they accept any administrative, legal, and criminal liability arising from such actions.

3.e. It is the responsibility of the individuals to back up the messages exchanged through the Site, and it is recommended by SİMPAŞ. SİMPAŞ is not responsible for any loss, deletion, or damage resulting from not backing up messages.

3.f. Visitors and Members cannot remove or delete any copyright, trademark, or any note under the Law on Intellectual and Artistic Works from any material copied or printed from the Site.

3.g. The risks associated with links on the Site that direct visitors to other websites are the responsibility of the Visitor/Member.

3.h. Specific rules and obligations related to sections of the Site may be mentioned in certain areas. Individuals and organizations using these sections are deemed to have accepted these rules in advance.

Rights and Obligations of SİMPAŞ

4.a. SİMPAŞ agrees and undertakes that Visitors/Members, except in the case of technical malfunctions, will benefit from the services mentioned in this Policy, and that personal information shared by Visitors/Members, excluding information opened to sharing, will not be shared with third parties or organizations except for those mentioned in the "Privacy and Personal Data Protection" regulations and notifications. If it is determined that a Visitor/Member is causing any electronic sabotage that hinders the operation of the Site, interferes with profits, and/or leads to an attack, or if there is a criminal complaint or official investigation request from official authorities regarding the visitor/member, SİMPAŞ has the right to investigate and disclose the identity of the relevant visitor/member.

4.b. SİMPAŞ may unilaterally amend this Policy at any time without notice to ensure the continuity of the services it has committed to. The Company may suspend, change, or cancel the service provided by the Site at any time, without providing any reason. Visitors/Members accept this provision in advance. Our Company will publish the updated current Policy on the Site with a new date update at the same link and will notify Visitors/Members by email if necessary. The updated current Policy will be effective as of its publication, and the use of the Site or its services will be subject to the updated Policy from that moment on.

  • Member information may be disclosed to authorized/relevant institutions within the framework of our legal responsibilities as stipulated by regulations.
  • In cases where the Site links to other internet websites/applications, the privacy-security policy and terms of use of those sites/applications shall apply to all usage and transactions; our Company is not responsible for any disputes, direct or indirect damages, or losses that may arise due to the use of information from other websites accessed from the Site for viewing advertisements, banners, content, or for any other purpose, as well as due to the ethical principles, privacy-security policies, service quality, and other practices of those sites.

SİMPAŞ is not responsible for any damages that may arise from information disclosures caused by unwanted and/or unforeseen reasons or due to the fault (intentional/negligent) of the Visitor/Member.

 

 

Other Provisions
  • 6.a. By visiting the Site, the Visitor/Member declares, accepts, and undertakes that they have read, understood, and agreed to all the articles in this Policy when the Member completes their membership registration by approving this Policy.
  • 6.b. The Visitor/Member shall compensate for any damages that SİMPAŞ may suffer due to their violation of the obligations they have undertaken in this Policy, and SİMPAŞ reserves the right to claim compensation from the Visitor/Member for any indemnities and/or administrative/judicial fines that it may have to pay to public institutions and/or third parties due to the Visitor’s/Member's breach of the Policy.
  • 6.c. SİMPAŞ accepts and undertakes that in the event of any disputes arising from the interpretation and application of this Policy, the competent authorities will be approached to resolve the dispute and/or complaint. All SİMPAŞ personnel acknowledge and declare that they are aware of this Policy and are obliged to comply with it. SİMPAŞ also accepts and undertakes that it will evaluate any complaints regarding violations of the Policy and will initiate necessary procedures if a violation is detected.
  • 6.d. The Visitor/Member agrees and undertakes that if any provision of this Policy is deemed invalid by a competent court, the applicable provision that is most appropriate to the intent of the original provision and closest to the parties' true intentions will be valid, and this will not affect the validity and enforceability of the other provisions of this Policy.
  • 6.e. The Policy has been made available to the public by being published on the Site.
  • 6.f. The Company reserves the right to unilaterally change the Policy in line with legal regulations.
  • 6.g. The current version of the Policy can be accessed from the Site.
